Terms and Conditions for
“Spider-Man: No Way Home”
Contest
- The following terms and conditions (“T&Cs”/ “ Terms and Conditions”) shall be applicable to the activity conducted by Films India Private Limited. on social networking websites website named ‘‘https://tapintothemultiverse.com’’ and (“Website”) relating to one of film titled ““Spider-Man: No Way Home”” (“Film”) which shall more specifically function in the manner detailed in the Specific T&C’s provided at the end of this document and the contest shall be referred to as the ‘Tap Into The Multiverse’ ( “Contest’”).
- The Contest shall be referred to with its title as mentioned above on Facebook, Instagram, YouTube and the Twitter pages / profiles. The T&Cs for the Contest shall consist of the following parts (A) Basic T&Cs for the Contest; (B) Specific T&Cs for the Contest; and (C) Release of Liability.
- A. Basic T&Cs:
Following are the terms that shall be applicable to the Contest:
- 1. The Contest is open only to Indian citizens residing in India. Citizens and/or residents of countries other than India are not eligible to participate.
- 2. Each person interested in participating in the Contest must be an adult having attained the age of eighteen (18) years as on the date of registering for the Contest. Such person shall be required to provide basic personal information about themselves including but not limited to name, mobile number and email address in order to register and participate in the Contest. The mobile number of each participant shall be verified by way of a one-time password and without successful verification, such participant will not be eligible to participate in the Contest. The information provided by such participants may be used for internal purposes and in the future to send to the participants promotional information pertaining by agreeing to the Terms and Conditions, each participant hereby acknowledges and gives free consent to collect, store and utilize the personal information shared by each participant.
- (All persons fulfilling conditions mentioned in section 1 and 2 shall hereinafter be referred to as “Participants")
- 3. RULES FOR PARTICIPATION:
- 3.1. The Contest terms and conditions shall be detailed on website https://tapintothemultiverse.com/ (“Website”) including without limitation the specific requirements and timelines for participation and the manner and basis of choosing and announcing the Winner, all of which shall be detailed in the Specific T&C’s.
- 3.2 By participating in the Contest, each Participant agrees to follow these Terms and Conditions and is deemed bound by any decisions made in its sole discretion, including any interpretations of the Terms and Conditions.
- 4. SELECTION OF THE WINNER:
- 4.1 Subject to the Specific T&C’s, participants will be selected as winner at the discretion of Sony Pictures Films India of this Contest through an automated process of random selection by a computerized program (“Winner”). – He / She alone only can claim the prize with proof of identification. Permissible POI is Passport only.
- 4.2. shall require the Winner to provide a valid photo identity documents including but not limited to a passport and ration card or any other government authorized identification that may be required for making the required arrangements for the Winner’s Prize, the details of which shall be as per the Specific T&C’s.
- 4.3. shall inform the Winner via email or phone number provided by the Participants at the time of entering the Contest. shall make a maximum of 2 (two) attempts each attempt being within 1 (one) hour of each other, to contact the Winner via the email id / mobile number provided by the Participants. shall not be held liable despite best efforts, in the event the provided mobile numbers/email Id is unreachable/not replied due to the following reasons including but not limited to: 1) Email ID or phone number provided by the Participant is incorrect; 2) Email ID belongs to a person other than the Participant; 3) Mobile number answered but individual answering refuses to acknowledge, the Contest and/or any relation thereto; and 4) Any other reason the Email ID or any other contact details provided by which Participant cannot be contacted.
- 5. THE PRIZE:
- 5.1. The Winner of the Contest shall be given (“Prize”).
- 5.2. The Prize will be awarded to the Winner pursuant to verification and in accordance with these Terms and Conditions. The Prize is not transferable, assignable or exchangeable for cash equivalent. Only the Prize Winner and no other person or agent, may claim the Prize.
- 5.3 While accepting the Prize, the Winner may be required to sign a separate “indemnity and release / waiver of liability” form provided and any other documentation as may be required. Failure to complete and sign any documents requested may result in disqualification and selection of an alternate Winner. All decisions are final in this regard.

- 5.4 In case the Winner is found to be in violation of any rules of the Contest, reserves the right to initiate legal proceedings against such person(s).
- 6. GROUNDS FOR DISQUALIFICATION:
- 6.1. Including its divisions, affiliates and subsidiaries, and their respective agents and representatives, employees shall not be responsible for any loss of entries for any reason whatsoever including, due to any technical problems for entries received after the deadline as a consequence of computer service delays, interruptions, electronic failures or overloads, or for lost, misdirected or misplaced entries. The entries are void if unreadable, inaccurate, incomplete, damaged, tampered with, falsified, mechanically reproduced, not in prescribed format, irregular in any way or otherwise not in compliance with these Terms and Conditions.
- 6.2. Participants shall not post any profanity or abusive comments on the Contest Website, digital and social media websites / pages and/or in any other manner on any other platform of. In the event of any such profanity or abusive comments posted on foregoing pages, such Participants shall be disqualified forthwith and reserves its rights, in addition to removing such post, to take a legal action against such participant and/or user.
- 6.3. Shall have the sole discretion to refuse to give the Prize to the Winner in the event of his / her fraud, dishonesty or non-entitlement to participate in the Contest under these Terms and Conditions.
- 6.4. Reserves the right to disqualify any participant if it has reasonable grounds to believe that the Participant has breached any of these Terms and Conditions.
- 6.5. Non-conformance by any Participant and/or Winner of the Contest will result in immediate disqualification of the Participant from participation or winning the Prize, as the case maybe.

- 7. INFORMATION PROVIDED BY PARTICIPANTS:
- 7.1. Shall keep all the information collected from the Participant’s confidential. Participants hereby acknowledge and agree that by sharing their personal information, shall have the right to share the information so collected with a third-party agency engaged as required for the purpose of the Contest and/or for the purpose of marketing, promotion and advertising of SPEI and its Films and all activities in relation thereto.
- 7.2. In exercise of the powers conferred by clause (ob) of sub-section (2) of section 87 read with section 43A of the Information Technology Act, 2000 (21 of 2000), the Central Government has framed the Information Technology (reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (“Privacy Rules”) which makes it mandatory for any concern to deal with any personal information including sensitive personal information as per the said Privacy Rules. In course of providing the aforesaid entries in the Contest, shall treat the information and pictures as sensitive and confidential and as per the aforementioned Privacy Rules such information has to be now dealt with as per the provisions specified in the said Privacy Rules. shall deal with any Data/information including sensitive personal information, if any, that it receives from or otherwise collects, holds, uses and processes in the following manner: a) Company may also disclose Data/information including sensitive personal information, if any, to governmental agencies and regulators (e.g., tax authorities), social organizations (e.g., the social security administration), human resources benefits providers (e.g., health insurers), external advisors (e.g., lawyers, accountants, and auditors), courts and other tribunals, and government authorities, to the extent required or permitted by applicable legal obligations upon prior written approval . b) The level of data protection using technical, managerial, operational and physical security control measures shall be such as to be in compliance with all applicable laws including but not limited to Information Technology Act, 2000 and Privacy Rules. c) The term ‘Data/information’ including sensitive personal information, if any, shall mean and include the name and contact information (home address, telephone and fax numbers and email address), valid identity proof such as passport number, driver’s license number, permanent account number (PAN), or other details pertaining to the identity of the Participants.
- 8. NOTWITHSTANDING ANYTHING CONTAINED IN THESE TERMS AND CONDITIONS:
- 8.1. Is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Contest is provided “As is” without warranty of any kind. makes no representations and disclaims all express, implied, and statutory warranties of any kind to the Participant and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, or fitness for any particular purpose.
- 8.2 Under no circumstance, unless due to willful misconduct or gross negligence, shall their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever. The Participant specifically agrees not to file in person / through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest.
- 8.3 By entering into the Contest, the Winner / Participants waive all copyrights including but not limited to Intellectual Property Rights and moral rights, rights of publicity and any related rights and consents to right to use the pictures uploaded by the Participants, the captioned posted for the Contest, picture, tape or portray him / her as the Contest Winner, and to exhibit this material in any and all media now existing or hereinafter created, including without limitation television, film, radio and print media, without any compensation whatsoever for advertising and publicity purposes, except where prohibited by law. The prize Winner also consents to right to use his/her name, voice or picture, or the content of his / her Contest entry (collectively, the “Publicity Rights”). can allow to its agencies to exercise/exploit the Publicity Rights in conjunction. shall also be free to use any ideas, concepts, know-how or techniques contained in the entries received for the Contest for any purpose.
- 8.4 Under no circumstance shall including any of its directors, employees, officers, affiliates or subsidiaries, be liable to the Participant and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if has been advised of the possibility of such damages.
- 8.5 Reserves the right to withdraw or discontinue and/or terminate the Contest at any stage without prior notice and without any liability whatsoever to the Participants.
- 8.6 The decisions its representatives shall be final and binding on all aspects of the Contest.
- 8.7 Shall not be responsible for any lost, late or misdirected computer transmission or network, electronic failures of any kind or any failure to receive entries owing to transmission failures or due to any technical reasons.
- 9. Miscellaneous:
- 9.1. Reserves its right to select and declare or not to declare the Winner in the event no Participant has submitted correct answers. Decision of this regard is final and no correspondence in this regard will be entertained.
- 9.2 Mere participation / submission of entries in the Contest do not entitle the Participants to win the Prize. Each Participant must complete the entire Contest as per the Terms and Conditions to be eligible as a Participant.
- 9.3 Has the right to substitute the Prize with other prizes of equal value, as determined by in its sole discretion.
- 9.4 Has the right to amend (add, delete or modify) the Terms and Conditions governing the Contest, prospectively or retrospectively, at its discretion and without prior notice.

- 9.6 All taxes, levies and duties due and owing under applicable and statutory laws in connection with all Prize if any, and all other costs, including insurance, incidental costs, gifts, gratuities and taxes, are the sole responsibility of the Prize Winner.
- 9.7 The Contest is void where prohibited by law. All relevant national and local laws apply.
- 9.8 The Contest shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Contest are subject to the jurisdiction of the Courts at Mumbai only.

Specific Terms of Participation / Process of Participation
1) The Contest will be conducted on the Website and promoted on various other social media platforms.
2) Participants will be required to select 1 (one) of 3 (three) possible answers (“Entries”) to a question given on the Website (“ Contest Question ”).
3) Each Participant shall have only 3 (three) attempts to answer the Contest Questions on each page.
Selection Process for the Winner
1) All the answers for the Contest Question will be collected from the entries received by.
2) All Participants selecting the correct answer will be eligible to be selected as the Winner by the method and/or any such other method as decided which shall be final and binding on the Participants.
3) SPEI shall declare the winner by contacting the Winner via email and phone in the manner detailed in the Basic T & C’s above.
4) The Winner has to be a resident of India and the Participants while participating into this Contest agree to accept decision as final without any further claim in this regard.
5) shall not entertain any mail or query questioning or otherwise asking for the definitive process for choosing the Winner and the Participants by participating in the Contest shall be bound by these T&Cs and Basic T&Cs.

Announcement of the Winner
Once the Winner has been finalized and has provided all required supporting documentation to , the Winner shall be publicly announced on Facebook, Twitter and Instagram along with a photograph of the Winner. may or may not announce the Winner via the Website.
